Terms and Conditions of Sale Álvarez Riveira
General Terms and Conditions for the Supply of Goods and Services of Alvarez Riveira, S.L. that will apply to accepted orders (2026)
1 Acceptance
The budgets or pro forma invoices provided by Álvarez Riveira do not constitute an offer. Acceptance by means of a signature from an authorised person (along with partial or total indication of the same if the offer requires it) implies the conversion into a firm order by the client and will be subject to the following conditions. It shall not be understood that the orders placed by the client have been accepted by Álvarez Riveira, S.L. without a document accepting the conditions thereof. All orders will be accepted at the exclusive discretion of Álvarez Riveira, S.L. The client does not have the right to unilaterally cancel any order once it has been accepted and processed by Álvarez Riveira in accordance with this Clause.
2 Risk and Title of Ownership
Notwithstanding the delivery of all or part of the goods, they shall remain the property of Alvarez Riveira until the customer has fully paid the purchase price, at which point the customer must keep the goods in such a way that it is clearly identifiable that they are the property of Alvarez Riveira, S.L. The risk of the goods will transfer to the customer when any of the following occurs (whichever happens first): a) the transfer of ownership to the Customer; b) the physical delivery of the goods to the customer.
3 Delivery of Goods
Unless otherwise agreed, Alvarez Riveira, S.L. will deliver the goods ExWorks at the facilities of Alvarez Riveira in Coruña or Santa Eugenia de Ribeira (as defined in Incoterms 2010). Alvarez Riveira may, at the request of the customer and always by mutual agreement, arrange the transport of the goods at the customer's expense and risk. The dates indicated for the delivery of the goods are always indicative, and Alvarez Riveira shall not be liable for any delays in delivery or the non-delivery of all or part of the goods caused by a Force Majeure event (*) or the customer's failure to provide adequate delivery instructions, a letter of credit or advance payment (when required) or any information related to the supply of the goods. In the event that Alvarez Riveira is responsible for the delay or non-delivery, either in whole or in part, of the goods, its liability shall be limited to:
- Refund the cost of undelivered goods by means of a credit note
- Or replace the goods within a reasonable timeframe
4 Returns
The Goods supplied under a firm order may not be returned under any circumstances without the prior written consent of Alvarez Riveira, S.L. As for the returns of after-sales parts, they will be subject to the following conditions:
- Returns must be requested within a maximum period of 14 days from the receipt of the items.
- A charge of 20% of the value of the returned goods will be applied, along with any applicable delivery charges.
- The returned goods must be in the same condition as when they were sold.
The risk of the Goods returned to Alvarez Riveira, S.L. without their consent shall rest exclusively with the customer until Alvarez Riveira acknowledges receipt of those goods.
5 Guarantee
The warranty period for the spare parts and accessories sold, when the spare parts and accessories sold have a warranty in accordance with the Contract and their duration has not been specified in the Contract, always with the content and exclusions of the warranty granted by the corresponding OEM, shall be: 12 months for new or ReCon spare parts and accessories. 60 days for used spare parts and accessories. 1 month for turbochargers. 1 month for injection systems (injectors, pumps). The warranty for labour shall be three months from the date of completion of the corresponding technical service, unless a longer period has been expressly agreed in writing. However, the warranty period for labour on turbochargers and injection systems shall be one month. The warranty period for spare parts and accessories from other brands or suppliers with whom we work, as well as for the labour used in repairs and other interventions of the technical service, shall be exclusively that granted in the Contract or by the corresponding manufacturer.
In the event of a fault with a specific spare part or accessory, another spare part or accessory will be supplied to the Customer, free of charge, as a replacement for the previous one. The spare parts and accessories that are replaced under the warranty conditions will be covered for the remaining warranty period corresponding to the initial supply. In the event that there are no stocks of the part to be replaced under warranty in the spare parts and accessories warehouse of Alvarez Riveira, S.L., the Customer will be refunded the price corresponding to the purchase amount. The warranty period for the installation of the supplied spare parts or accessories will be three months from the date of completion of the installation. In any case, the liability of Alvarez Riveira, S.L. for faults in the sold spare parts or accessories or for their installation will be limited to the warranty period and the price paid by the Customer to Alvarez Riveira, S.L. for the faulty spare part or accessory or for its installation, and Alvarez Riveira, S.L. cannot be held responsible for any other damage or loss, whether direct or consequential, or loss of earnings.
In the repair services offered, Alvarez Riveira, S.L. will not provide any warranty on the workmanship of replacement materials used that are not supplied by our own company, and the customer will assume the risk of any damage that may be caused by those materials or parts provided by the customer themselves. Likewise, Alvarez Riveira, S.L. is not responsible for breakdowns and failures of the supplied parts, resulting from improper installation by unapproved and/or unqualified personnel for such intervention.
Alvarez Riveira will not provide any warranty or carry out interventions in any case (unless agreed in advance with the client) with materials not supplied by us.
6 Payment
The payment conditions will be those agreed upon in the budgets with the client and will always be subject to changes depending on the risk granted for the client that Solunion (the credit insurance company with which Alvarez Riveira, S.L. works) offers us at that moment. In the absence of coverage from Solunion, a payment guarantee will be required for any other form of payment other than cash. If there are overdue payments, Alvarez Riveira, S.L. reserves the right to charge interest to the client at a rate of two percent (4%) per month on the outstanding amount, following written notification to the client, and the possibility of suspending future deliveries or services provided until the overdue amounts are rectified.
(*) Force Majeure: Acts of war or terrorism, riots or civil disturbances, strikes, lockouts or other labour conflicts, epidemics and pandemics, accidents, fires, floods, storms, restrictions and government actions, embargoes, delays or failure to deliver materials, failures in transport or electricity supply, or other circumstances beyond the control of Alvarez Riveira, S.L.
Financing conditions(Spirit 1.0 + eLite)
Financing subject to approval by the collaborating financial institution and validation by Álvarez Riveira.

- Available terms: 3, 6, 10, 12, 18 or 24 months, at the customer's choice and subject to approval
- Interest rate: 0% APR (no interest or fees for the customer)

The approval, final conditions, and amount granted will depend on the risk assessment of the financial institution. The conditions may vary depending on the client's profile.
